General terms and conditions of business

§ 1 General

These general terms and conditions apply to all courses offered by the language school SilkeStoffel.de.

§ 2 Conditions of participation

Participants must be at least 18 years old. Minors require written consent from their legal guardians.

§ 3 Registration and method of payment

Registration for courses at the SilkeStoffel.de language school takes place by booking a course via the language school’s website. The student/customer completes the booking process online only and confirms the binding booking of the course selection in the last step by clicking on the button “Complete booking now”, after previously accepting these General Terms and Conditions (GTC) by activating the checkbox on the booking page. After this step, the student/customer is redirected to select the payment method via the payment service provider Mollie. Only after successful payment will the student/customer receive a booking confirmation. Upon receipt of this booking confirmation, the contract is deemed to be concluded.

§ 4 Conduct of the courses

The language school SilkeStoffel.de undertakes to carry out the planned teaching units. Depending on the course, a lesson lasts 45/60 minutes. The implementation of the courses for companies and businesses depends on a minimum number of participants, depending on the course booked. The minimum number of participants is stated in the course offer on the website. The start of the course may be delayed until this minimum number of participants is reached. The language school SilkeStoffel.de reserves the right to cancel or postpone courses for operational reasons.

§ 5 Termination and term

The student/customer can terminate the contract up to 14 days before the start of the course without giving reasons. The termination must be made in writing. If you cancel between 14 days and the start of the course, the course fee will be credited towards an alternative course. These credits are not transferable. If you cancel after the course has started, the course fee will not be refunded. The registration fee will be retained in any case. Failure to appear does not constitute termination. If the minimum number of participants is not reached or for unforeseeable reasons that are not the responsibility of the language school (e.g. sudden absence of teachers), the language school can terminate the contract without notice. In these cases, payments already made for lessons not taken will be refunded.

§ 6 Right of withdrawal

Students/customers have a right of withdrawal for contracts concluded online. Details on the conditions and legal consequences of the right of withdrawal can be found in the attached cancellation policy.

§ 7 Disclaimer

No liability is accepted for accidents on the premises of the SilkeStoffel.de language school, on the way there and back, or during trips and excursions. This also applies to theft, loss or damage to personal items.

§ 8 Compliance with the house rules

By signing, the student/customer undertakes to observe the posted house rules. Violations may result in exclusion from classes and termination without notice.

§ 9 Data protection

The language school SilkeStoffel.de collects data when inquiries are made via the online form, by email or when a contract is concluded. This data is collected, stored and processed in accordance with the provisions of German data protection law and is used exclusively to process the contracts concluded between the language school and the student/customer. Students/customers have the right to information as well as to correction, blocking and deletion of their stored data at any time, provided that there is no statutory retention obligation to the contrary.

§ 10 Copyright protection

Making sound and image recordings during on-site lessons, but also explicitly online lessons, is prohibited without permission for copyright reasons. The teaching materials provided by the language school may not be distributed or reproduced publicly without permission.

§ 11 Special provisions for language visas

For students/customers who require a language visa to enter the country, the entire course fee is due upon registration and must be transferred immediately. After receipt of payment, the language school will issue the registration confirmation and send it by email or post. The shipping costs are borne by the student/customer. If the visa is refused, the written rejection notice from the responsible consulate must be presented. After receipt, the course fee minus the registration fee will be refunded by bank transfer. The costs of the return transfer are borne by the student/customer. In case of non-participation for other reasons, no refund will be made unless the language school is responsible for this.

§ 12 Additional agreements

Deviations from these General Terms and Conditions must be made in writing. Oral agreements are invalid.

§ 13 Severability Clause

Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

Cancellation policy and sample cancellation form for contracts concluded online

Right of withdrawal

You have the right to withdraw from the contract concluded online within fourteen days without giving any reason. The cancellation period shall be fourteen days from the day on which the contract is concluded. To exercise your right of withdrawal, you must contact us, [Sprachschule SilkeStoffel.de, Dr.-Wilhelm-Roelen-Str. 388, 47179 Duisburg, E-Mail: info@silkestoffel.de], by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the model cancellation form below, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will reimburse you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount corresponding to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the services provided for in the contract.
